These terms of use govern your access to and use of the Capturia platform and its related services. By creating an account or using our services, you agree to be bound by these terms. If you do not accept these terms, please do not use our services.
Capturia Inc. ("Capturia") provides a sales automation platform designed for small and medium businesses (SMBs). The platform includes the following features:
To use our services, you must be a legally constituted business in Canada or an independent professional. You represent that you have the authority to bind your organization to these terms. Capturia's services are not intended for individual consumers or persons under 18 years of age.
You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You agree to notify us immediately of any unauthorized use of your account. Capturia reserves the right to suspend an account in the event of suspected fraudulent or non-compliant use.
Capturia integrates with third-party services (Google Calendar, Zoom, Stripe, Meta, and others) to provide its features. By connecting a third-party service through the platform, you acknowledge and agree that:
Capturia uses artificial intelligence technologies (including OpenAI and AssemblyAI) for lead qualification, sales coaching, conversation analysis, and call transcription. By using these features, you acknowledge that:
Setup fees are payable upon contract signing. Monthly subscriptions are billed in advance. Payments are processed securely by Stripe. All payments are in Canadian dollars unless otherwise specified. Payments are non-refundable except under our performance guarantees (see section 7).
Our performance commitments are detailed on our Guarantees page: Triple Protection for the Automated Scaling Blueprint and +10% guarantee for the Full Service. Guarantees apply according to the conditions, exclusions, and terms specified in that documentation.
Capturia retains all intellectual property rights in its platform, AI agents, workflows, methods, and documentation. You retain full ownership of your client data, content, and communications. You grant us a limited, non-exclusive, revocable license to process your data in the course of providing our services. This license terminates upon account termination.
Capturia strives to maintain platform availability at all times but does not guarantee a specific uptime rate. Planned interruptions (maintenance, updates) or unplanned interruptions (technical incidents, force majeure) may occur. We will make reasonable efforts to minimize the duration and impact of any interruption. Capturia shall not be held liable for damages resulting from temporary service unavailability.
To the maximum extent permitted by applicable law, Capturia's total liability to you, regardless of cause, shall not exceed the total fees you have paid us during the twelve (12) months preceding the event giving rise to the claim. In no event shall Capturia be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, data, or business opportunities.
You may cancel your subscription at any time by providing written notice with thirty (30) days' advance notice. Upon termination, your data remains accessible for 30 days to allow you to export it. After this period, it is deleted in accordance with our Privacy Policy. Capturia reserves the right to suspend or terminate your access immediately and without notice in the event of breach of these terms, fraudulent use, or non-payment.
We may modify these terms at any time. Material modifications will be notified to you by email at least thirty (30) days before they take effect. Your continued use of the platform after the effective date of the modifications constitutes your acceptance. If you do not accept the new terms, you may terminate your account in accordance with section 11.
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these terms shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Quebec, Province of Quebec, Canada.
